Terms of use
Your writing is yours. Here is the rest.
What is free, how a subscription works and how to stop one, and what we can and cannot promise.
Who we are
AKnght2Write is made by AKnght Studios LLC, an Oregon limited liability company in Portland, Oregon (“we”, “us”). These terms are an agreement between you and us about your use of the app. By installing or using AKnght2Write you agree to them. If you do not agree, please do not use the app.
Your writing
Everything you write or dictate in AKnght2Write belongs to you. We claim no rights in it, we never receive a copy of it, and the app sends it nowhere unless you share or export it. Where your documents are kept, and what the app keeps about you, is set out in the privacy policy.
Your documents are ordinary files on your device, in the app’s folder or one you chose. Keeping backups of them is up to you, and we encourage it: we cannot recover a file that has been deleted or lost from your device, because we never had a copy.
What is free
Without a subscription you can dictate, without a time limit, in one document: the first one the app makes, or the one you pick when the app asks. Every other document can still be opened, typed in, read back and exported. After 2,000 dictated words in a week a reminder appears from time to time; dictation in your free document does not stop.
Subscriptions
A subscription lets you dictate in every document. It is offered monthly and yearly. The price, and what is included, are shown in the app and in the store before you buy.
- Payment. Payment is charged to your App Store or Google Play account when you confirm the purchase.
- Automatic renewal. A subscription renews automatically for the same period, at the then-current price, until you cancel it. On the App Store, it renews unless it is cancelled at least 24 hours before the current period ends, and the renewal is charged within those 24 hours. On Google Play, it renews on its renewal date unless it is cancelled before then.
- Cancelling. You can turn off automatic renewal at any time in your store account settings. On an iPhone or iPad: Settings, your name, Subscriptions. On Android: the Google Play Store app, your profile picture, Payments & subscriptions, Subscriptions. The app’s Settings › Subscription screen links there too. Uninstalling the app does not cancel a subscription.
- After cancelling. You keep your subscription until the end of the period you have paid for. After that the app goes back to the free terms above. Nothing you wrote is removed or locked.
- Refunds. Purchases are handled by the store, and refunds are subject to its policies: Apple’s at reportaproblem.apple.com, and Google’s through Google Play. We cannot issue refunds for store purchases ourselves.
- Price changes. If a price changes, the store tells you beforehand as its rules require, and where the store requires it, the new price applies only once you have agreed to it.
- Restoring. A subscription belongs to your store account, not to a login with us. On a new or reset device, Settings › Subscription › Restore purchases brings it back.
- Offline use. Because the app makes no network calls of its own, it relies on your device’s store to confirm a subscription. If a renewal cannot be confirmed because the device has been offline, the app keeps treating the subscription as active for up to 30 days before it goes back to the free terms. When the store confirms the subscription again, it resumes.
Your licence to use the app
We give you a personal, non-exclusive, non-transferable licence to use AKnght2Write on devices you own or control, as allowed by the store you got it from. You may not sell, rent or redistribute the app, or try to get around the subscription, except as the law allows.
If you got the app from the App Store, Apple’s Licensed Application End User License Agreement also applies. If you got it from Google Play, the Google Play Terms of Service also apply. Where they conflict with these terms, the store’s terms govern.
AKnght2Write includes open-source software, each part under its own licence, listed in the app. Those licences are not changed by these terms.
What the app can and cannot do
Speech recognition is automatic and makes mistakes, particularly with unusual names, noise and quiet speech. Read what the app wrote before you rely on it. The app is designed never to lose what you say, but no software is perfect, so keep backups of anything that matters to you.
AKnght2Write is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties beyond those the law requires, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data or writing, arising from your use of the app. Our total liability to you for any claim about the app is limited to the greater of the amount you paid for it in the twelve months before the claim and US$50. Some places do not allow some of these limits; where that is so, they apply only as far as the law allows, and nothing in these terms takes away rights you have as a consumer that cannot be taken away.
Ending these terms
You can stop using the app at any time by uninstalling it; to stop paying, cancel the subscription in your store account as described above. If you break these terms in a serious way, your licence ends. Your documents remain yours whatever happens.
Changes to these terms
If we change these terms, we will post the new version here with its date. If a change is significant, we will say so on this page and in the app’s release notes at least 30 days before it applies. Continuing to use the app after a change means you accept the new terms.
Law
These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law rules. This does not take away the protection of the consumer laws of the place you live, where those laws apply to you.
